Border Patrol agents shot beanbags at a group of suspected bandits before the men returned fire during a confrontation in a remote canyon, killing agent Brian Terry with a single gunshot, records show.

And an illegal immigrant wounded in the gunbattle who is now the only person in custody linked to the slaying contends he never fired a shot, according to FBI search warrant requests filed in the U.S. District Court in Tucson.

The documents provide the most detailed version yet of what happened in the deadly gunbattle Dec. 14 in Peck Canyon, northwest of Nogales.

The documents say the group of illegal border entrants refused commands to drop their weapons after agents confronted them at about 11:15 p.m. Two agents fired beanbags at the migrants, who responded with gunfire. Two agents returned fire, one with a long gun and one with a pistol, but Terry was mortally wounded in the gunfight.

Border Patrol officials declined to answer questions about protocol for use of force, citing the ongoing investigation.

But Terry’s brother, Kent Terry, said the other agents who were there that night told him that they were instructed to use the non-lethal beanbags first. It’s a policy that doesn’t make sense to Kent Terry.

Working Together: ‘Revolutionary Socialist’ Leads Moveon.org Union Rally in Dallas

Over the weekend, a self-proclaimed “Marxist” and “Revolutionary Socialist” showed up at a pro-union rally (reportedly one of the ones sponsored by Moveon.org and Van Jones) in Dallas. Not only was he there, but he was also leading the chanting. Such gems as “No war but class war!“ and ”They say cut back we say fight back!” flowed from the the lips of the protesters.

Later in the day, the group RedWhiteBlueNews approached the chant leader to ask him what socialism has to do with unions. Not only does he admit the unions are the “first step” in achieving a Marxist system, but that is also when he admits he’s a “revolutionary socialist.”

Wisconsin’s Final Throes Begin ─ Polls Blame Democrats

The fallout officially has begun in Wisconsin’s public-employee union impasse, as teachers in several Wisconsin school districts received layoff notices Monday, while President Barack Obama and his Democratic allies started feeling the heat of public opinion turning against them.

Obama interjected himself in the controversy scott,walker,obama,wisconsinagain Monday, after carefully avoiding the Wisconsin controversy since his Feb. 17 statement that GOP Gov. Scott Walker’s proposals represent “an assault on unions.”

“I think the White House sensed that it would be no end of trouble if they started meddling in state budget disputes,” University of Virginia Center for Politics Director Larry J. Sabato told Newsmax.

Yet at a Monday meeting of U.S. governors at the White House, Obama seemed to lecture the governors that public employees should not be “denigrated or vilified.”

Obama added that “everyone should be at the table” when budget decisions are made in a spirit of “shared sacrifice” — the same terms union leaders have used to defend collective bargaining in the face of massive state deficits.

Rising GOP star and New Jersey Gov. Chris Christie could be seen shaking his head as the president suggested that Republican governors were vilifying public employees. He later told reporters that Obama was “playing politics to his political base.”

“He’s already getting ready for re-election,” Christie told NorthJersey.com.

“No one’s demonizing or vilifying public employees,” Christie added. “What we’re doing is, for once, telling the truth about how much they cost. And the only reason for that is because their unions make outlandish demands and have won in the past.”

Walker also fired back at Obama Monday afternoon with a statement pointing out that most federal employees are not allowed collective bargaining for wages and benefits, “while our plan allows it for base pay.”

“And I’m sure the president knows that the average federal worker pays twice as much for health insurance as what we are asking for in Wisconsin,” Walker stated. “At least I would hope he knows these facts.”

Rather than vilify public employees, Walker said he had “repeatedly praised the more than 300,000 government workers who come to work every day in Wisconsin” despite the labor action going on in his state.

And in a thinly veiled remark that was perhaps his sharpest rebuke yet to Obama, Walker said: “I’m sure that President Obama simply misunderstands the issues in Wisconsin, and isn’t acting like the union bosses in saying one thing and doing another.”

Walker says that, without the budget bill, state agencies will have to begin preparations this week to send out layoff notices to 1,500 state workers.

Now government wants to control tidiness of churches

A New Hampshire city official has taken the old saying “cleanliness is next to godliness” one step too far in a battle now raging over the tax status of a church building, determining that cleanliness is godliness, according to a legal team in the midst of the fight.

The dispute concerns Liberty Assembly of God, now called Destiny Christian Church, over its decision to use its building to feed the hungry and help the needy, and the resulting impact on its building.

It appears a city official didn’t like clutter, and concluded the church couldn’t be religious with it there.

It was several years ago that the foundations of the problem were set in place, when Concord, N.H., officials decided that if the church used its building to house the homeless and meet missionaries’ needs, it would no longer be a church because those weren’t “religious” purposes.

A subsequent room-by-room inspection of the facility was conducted by city officials, and their determination was that such activities were not religious, so the legal experts with the Alliance Defense Fund jumped into action. They now have pending a tax appeal for the church’s 2008 taxes as well as a lawsuit over the 2009 taxes.

A ruling in the 2008 case could be coming any day, but it’s uncertain whether that will resolve the complications that arose following comments from Kathryn Temchack, the city’s director of real estate assessments, who said the church must be stripped of its full tax exemption because its rooms were not clean.

Walker Explodes Union Lies on ‘Meet the Press’

Wisconsin Gov. Scott Walker says he won’t cave in to union and Democratic demands that he compromise on his effort to curb employee benefit programs. He also vows he won’t “kick the can down the street” when it comes to dealing with his state’s fiscal woes.
Appearing Sunday on NBC’s “Meet the Press” with David Gregory, Walker laid out his plan to save his state from fiscal bankruptcy while destroying several false claims about his legislation, which Senate Democrats are delaying by refusing to appear for a final vote.
Among the significant issues covered during his “Meet the Press” interview, Walker:
  • Denied he is destroying public employee unions.
His proposed law still allows public employee unions to exist and engage in collective bargaining for their wages. The state denies the unions the use of collective bargaining to seek pension and health benefits.
  • Claimed that unions are not acting in good faith.
Public employee unions have been claiming they will accept cutbacks in their benefits, but Walker says they can’t be trusted and have been rushing through contracts that give their members extravagant benefit packages.
Walker told Gregory: “We [have] seen that actions speak louder than words. For us to balance the $3.6 billion deficit we have — but not only now, but to ensure we can continue to do that in the future so our kids don’t inherit these same dire consequences — we’ve got to have assurances. And over the past two weeks, even after they made those promises, we’ve seen local union after local union rush to their school boards, their city councils, their technical school boards and rush through contracts in the past two weeks that had no contributions to the pension and no contribution to health care. And, in fact, in one case in Janesville, they actually were pushing through a pay increase. Actions do speak louder than words.”
  • Explained that the law helps local governments curb union demands.
Walker said: “This bill precisely helps local governments, and it’s effective once it passes. In fact, we’re, we’re facing a $3.6 billion deficit. Like nearly every other state across the country, we’re going to have to cut more than a billion dollars from our schools and local governments. You know, in New York and California, where there are Democrats for governors, they’re doing that. The difference here is, with this budget repair bill, we give those schools and local governments more — almost a billion and a half dollars worth of savings. So the savings they get from our budget repair bill exceed the amount.”
  • Said public employee unions are making unusual demands on taxpayers.
Walker said: “In Wisconsin, a great example of that is, we have, in many of our school districts, a requirement through collective bargaining contracts that they have to buy their health insurance from a company that’s owned by our state teacher’s union, WA Trust. Because of that, it costs them up to $68 million more than if they could just buy it from the state employee healthcare plan. Those are real costs about putting real money in the classroom instead of into these collective bargaining agreements.”
  • Pointed out his new plan is consistent with how the federal government handles many employees.
Walker explained: “Well, our proposal is less restrictive than the federal government is today. Under Barack Obama, he presides over a federal government where most federal employees do not have collective bargaining for, for benefits, nor for pay. So what we’re asking for is something less restrictive than what the federal government has.”
  • Explained why police and firemen are exempt from his new law.
Walker said: “We saw two weeks ago, when this debate first started, teachers here in Madison walked off the job for three days. Now, that was an inconvenience for a lot of parents. I know I’ve got two public — kids in public school. Anytime you have a disturbance like that, it’s an inconvenience. But that, contrasted to the fact that even if there was one jurisdiction across the state where firefighters or police officers weren’t on the job in full force, I can’t afford to have a fire or crime committed where there’s a gap in service. And it ultimately just boils down to public safety.”
Walker concluded by telling Gregory that he stands by his statement, “This is our moment, this is our time to change the course of history.”
Walker told Gregory: “It’s one of those where, for year after year after year, not just the last governor, but governors before, legislatures before, have kicked the can. They’ve taken one-time fixes to push the budget problems off into the future. We can’t do that. We’re broke. Like nearly every other state across the country, we’re broke. And it’s about time somebody stood up and told the truth in this state and said, ‘Here’s our problem. Here’s the solution,’ and acted on it. Because, if we don’t, we fail to make a commitment to the future. Our children will face even more dire consequences than what we face today.”

Unions’ collective disregard for taxpayers

The mayhem in Madison, Wis., over the last two weeks has highlighted the determination of organized labor unions to continue to restrict workers rights, and to try to intimidate Gov. Scott Walker and the taxpayers into some more unsustainable demands.

Choosing to join a union in one thing. Being forced to do so as a condition of employment is a restriction on a worker’s rights. Joining a union or any other organization should be an individual’s choice. And the desire of the unions to continue to make unsustainable demands on local, state and federal government, irrespective of the devastating financial impacts, is totally illogical, not to mention being a collective disregard for the nearly 90 percent of the workers and taxpayers who pay them.

For years in some states, the unions have consistently helped elect Democratic governors and legislatures who have said thank you by passing union-favored legislation for the benefit of the unions and re-election of their Democratic friends. The Democrats would then find ways to pass these favors and demands on to the taxpayers in the form of higher taxes. And when the Democrats could not raise taxes high enough and fast enough, they would create deficits and future commitments to force future tax increases.

Little by little, this political favoritism has made the disparity between total compensation for public-sector employees and private-sector employees bigger and bigger – and unsustainable.

Then in Wisconsin, Republican Gov. Scott Walker and a Republican state Legislature got elected after eight years of Democratic control in the governor’s office and the Legislature. Walker announced to the public that Wisconsin is broke! Instead of letting the state’s credit card continue to go past its spending limit, he proposed a solution, which does not include raising taxes as the unions have forced the Democrats to do for many years.

If I didn’t know better, I’d think Barack Obama’s middle name was Nero.

It isn’t, but he’s doing a great job of impersonating the Roman emperor who “fiddled while Rome burned.”

OK, I know it was a lyre he played but “fiddle” sounds so much better!

It’s as though Obama is following Nero’s playbook: Party down and have fun while ignoring the local/domestic problems, avoiding the pressures of outsiders and ruling with autocratic aplomb – or maybe I should say, chutzpah.

What do you say about a president and his family who seem to take a vacation every chance they get while simultaneously preaching piously to “the people” that we all have to cut back, to sacrifice?

Just as with Nero, our leaders don’t set a good example.

Motown and Super Bowl parties serving delicious but high-calorie eats while the first missus preaches to the little people about avoiding fats and sugars and salt and fried food and non-organic vegetables and carbonated beverages.

After urging “sacrifice,” the first missus and the kids are off to a ski vacation and pricey digs with all the necessary security. Despite the exercise on the slopes, there were dining treats, including high-calorie barbecued ribs.

Back home at the White House, Obama was dealing with the dangerous cauldron that the Middle East has become but was interrupted by an urgent call from his daughter’s basketball team: They needed a coach for a game that night.

The leader of the free world, our president, knew his prioritiesjust like Nero – and dropped everything and coached the game as a fill in – even though, his daughter wasn’t even there! She was AWOL on the slopes with the first mom.

It smacks of Obama’s choices during the BP oil spill. While the little people suffered losses and the company struggled to stem the leak, Obama played golf.

Then, when it was over, it was time for another vacation, in Cape Cod after a short, perfunctory visit to the Gulf Coast.

The Hawaii Christmas vacation was another choice – lots of cost to the taxpayers, lots of entourage, lots of golf, junk food and shave ice.

Just like the little folks who, Obama constantly reminds us, must be willing to make sacrifices – you know, by cutting back on daily expenses and unnecessary activities like vacations and parties.

I won’t even detail the trips to England, France and Spain – and we’re only two years into his term.

But worse are his choices that put our security at risk. Tunisia exploded and it continues – nary a word from BO. Egypt erupts in violence, and while one side of the “administration mouth” says we won’t be involved in telling another country what to do, the other side orders Hosni Mubarak to give up and get out.

When Libyans revolt against Moammar Gaddafi, and he responds by mowing down his own people, Obama is ominously silent. When he finally says “something,” he manages not to mention Gaddafi’s name but ultimately, he orders him out of office, too.

So much for not getting involved.

Mix in Bahrain, Yemen, Morocco, Jordan, Saudi Arabia and Iran – and you have the makings of a real crisis for the U.S. and what could turn into a deathwatch for Israel.

Does Obama say anything about the overall threats?

No.

President Obama must embrace Islam as a way of life or face the consequences of a trial under the Shariah Islamic court system, declared British extremist cleric Anjem Choudary.

Choudary, founder and former chief of two Islamic groups disbanded by the British authorities under anti-terror legislation, is planning a Washington protest later this week in which he says he will call on American Muslims to revolt against the country and implement Shariah law.

Speaking in an interview with investigative reporter Aaron Klein on his program on New York’s WABC Radio, Choudary claimed Obama was waging a war against Islam.

“[Obama] has promised all Muslims to be released from Guantanamo Bay. They are still languishing there even though he knows they are completely innocent,” Choudary claimed.

“On top of that, he’s increased the number of U.S. forces in Afghanistan, so he is a warmonger just as his predecessor was. And thirdly and more importantly,” Choudary said, “the Muslims don’t want democracy and freedom. Democracy and freedom are anathema to Islam and the Shariah.”

Gingrich: Obama Sparks ‘Constitutional Crisis,’ Raises Impeachment Specter

In an exclusive interview with Newsmax.TV Friday, former House Speaker Newt Gingrich said President Barack Obama’s decision not to fully enforce the Defense of Marriage law has sparked a constitutional crisis as he has directly violated his constitutional duties by arbitrarily suspending a law.

Gingrich for the first time raised the specter of Obama’s removal from office, noting that, if a “President Sarah Palin” had taken a similar action, there would have been immediate calls for her impeachment.

Obama Attorney General Eric Holder said on Wednesday that the administration will not defend the constitutionality of the Defense of Marriage Act in the courts, which has banned recognition of same-sex marriage for 15 years. President Clinton signed the act into law in 1996.

Obama’s decision to forego a legal defense of the law has caused a firestorm of anger from conservative groups.

Gingrich slammed Obama for his decision, telling Newsmax that he is not a “one-person Supreme Court” and his decision sets a “very dangerous precedent” that must not be allowed to stand.
